Please read these Terms of Service carefully before using Motionhorse. By accessing or using the platform, you agree to be bound by these terms. If you disagree with any part, you may not use the service.

The Service

Motionhorse is an AI-powered motion graphics platform that allows users to create, preview, and render product videos by selecting scene templates, providing product information, and optionally using AI to generate video copy. The platform is operated by Fifth Avatar Inc.

User Accounts

You must sign in with a valid Google account to use Motionhorse. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or are inactive for extended periods.

Acceptable Use

You agree not to use Motionhorse to:

  • Create content that infringes third-party intellectual property rights.
  • Generate misleading, defamatory, hateful, or illegal content of any kind.
  • Attempt to reverse-engineer, scrape, or extract the platform's scene templates, animation code, or AI prompts.
  • Resell or sublicense access to the platform without prior written agreement.
  • Circumvent rate limits, credit checks, or tier restrictions.

Credits, Subscriptions & Billing

Free plan:Free users receive a limited number of lifetime render credits and AI generation credits. Once exhausted, an upgrade is required to continue. Free renders are exported at 480p and include a "Made with Motionhorse" watermark.

Paid plans (Pro, Agency, Enterprise): Subscriptions are billed monthly or annually in advance. Credits are allocated at the start of each billing cycle and do not roll over to the next cycle.

Credit usage: Render credits are deducted when a render job completes successfully. Credits used for completed renders are non-refundable.

Cancellation: You may cancel your subscription at any time via the customer portal. Cancellation takes effect at the end of the current billing period. You retain full access to all paid features, your credit balance, and the ability to render until that date. No access is revoked early.

Refunds: Subscription fees are non-refundable. We do not issue refunds upon cancellation — your subscription simply does not renew after the current period ends and you keep access until then. Unused credits at the end of a billing cycle are not refunded or carried over. If you believe a charge is in error, contact [email protected] within 14 days of the charge and we will investigate.

Free Tier Watermark

Videos rendered on the Free plan include a "Made with Motionhorse" watermark composited into the exported MP4. This watermark is part of the Free plan by design and cannot be removed without upgrading. By using the Free plan, you acknowledge and accept this condition.

AI-Generated Content

Motionhorse uses third-party AI services to generate video copy from the product information you provide. You are responsible for reviewing AI-generated content before publishing or distributing any video. Motionhorse makes no warranties about the accuracy, completeness, or fitness of AI-generated content for any particular purpose.

By providing a website URL for AI scraping, you confirm you have the right to allow automated access to that URL and that you consent to the scraping as described in our Privacy Policy.

Intellectual Property

Your content: You retain full ownership of all videos you create and export using Motionhorse. You may use exported videos for any purpose including commercial distribution, advertising, and client work.

Platform assets: All scene templates, animation code, backgrounds, UI components, and other platform assets are the exclusive property of Fifth Avatar Inc and protected by copyright. You may not copy, extract, or redistribute them.

Third-party assets: Stock audio tracks included in the platform are licensed for use within exported videos. You may not redistribute the raw audio files as standalone downloads.

Video Output License

Paid plan users (Pro, Agency, Enterprise): You are granted a perpetual, worldwide, royalty-free license to use, distribute, publish, broadcast, and monetise videos you export from Motionhorse. This includes use in commercial advertising, client deliverables, social media, and paid campaigns. You own the output.

Free plan users: You may use exported videos for personal and non-commercial purposes only. Commercial use of watermarked Free plan exports is not permitted. Upgrade to a paid plan to unlock commercial rights.

Audio tracks: Stock audio bundled with the platform is licensed for synchronisation within exported videos under all plans. You may not redistribute, resell, or use the raw audio files outside of a Motionhorse-exported video.

Scene templates and animations: The underlying scene code, animation logic, and platform assets remain the exclusive property of Fifth Avatar Inc and are not transferred to you. The license covers your exported video file only.

DMCA / Copyright Infringement

If you believe content on the platform infringes your copyright, submit a DMCA notice to [email protected] with the following:

  1. Your electronic signature or that of a person authorized to act on the copyright owner's behalf.
  2. Identification of the copyrighted work claimed to be infringed.
  3. Identification of the infringing material and its location on the platform.
  4. Your contact information (address, phone, email).
  5. A statement that you have a good faith belief the use is not authorized by the copyright owner.
  6. A statement under penalty of perjury that the information is accurate and you are authorized to act on the copyright owner's behalf.

Disclaimer of Warranties

The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that renders will complete without failure.

Limitation of Liability

To the maximum extent permitted by law, Fifth Avatar Inc's total liability for any claim arising out of or relating to the service is limited to the amount you paid in the three months preceding the claim, or $100 USD, whichever is greater. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages.

Governing Law

These Terms are governed by the laws of India, excluding its conflict of law rules. Any dispute shall first be attempted to be resolved informally by contacting us. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of India.

Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on the platform at least 14 days before taking effect. Continued use of the platform after that date constitutes acceptance of the revised Terms.
